ARCO OASIS RENTAL LLC – FOUR WHEEL ATV RENTAL LIABILITY RELEASE AOR will not be responsible in any way for any accident, injury, or death occurring from the use of ATVs rented from AOR. IF YOU ARE NOT WILLING TO ACCEPT THE INHERENT RISK OF ATV USE, AND THE POSSIBILITY THAT YOU OR YOUR FAMILY AND FRIENDS CAN BE HURT AND/OR KILLED, DON’T RENT THE ATV. If you want the privilege of renting an ATV, you also have to accept the risks involved and the personal financial expense that may occur if you are injured and/or the machine is damaged. Your signature below confirms that you are aware of and accept the risks involved while operating an ATV. Renter agrees to return the ATV on or before the day and time indicated within this agreement unless other arrangements have been made by mutual agreement. NO REFUND for early returns. Renter agrees to keep each Rental in a safe place while unattended. Retrieval of damaged or wrecked ATV(s) will be charged a recovery fee. Operating any Rental while under the influence of alcohol or drugs is strictly prohibited and is subject to prosecution. Renter agrees to pay for down time (due to damage caused by Renter) and red tag parts (overnight delivery), plus the full cost of repairs if the ATV is damaged. Security deposit: valid credit card or $500.00 cash deposit per machine. If reservations are made, at least a ten (10) day cancellation notice is required or a 10% charge will apply for each day less than ten (10). If an ATV is returned late (without prior arrangement with AOR) the Renter shall be charged incrementally at $25 an hour. Normal rental hours are during the hours of operation of Arco Oasis LLC Convenience Store. By my signature, I acknowledge risk and agree to repair or replace the machine, as well as pay for lost rental time for the ATV damaged during the period of time covered by this rental agreement and all amended time periods. Main Causes of Accidents: Following too close (rear-ending). Turning too sharp, especially at faster speeds. Side-hilling on steep hills. Inattention, hitting a rock at the side of the trail.
Always Wear a Helmet – It’s proven that helmets significantly reduce the number and severity of head injuries. We also recommend that you wear eye protection and sturdy boots at a minimum. Eye protection and helmets are provides as part of all ATV rentals. The helmet is also a Bureau of Land Management (BLM) requirement as it can also be used as a vessel to hold a fire retardant (such as water) if a fire is started, and must be with the ATV when riding on the BLM.
Carrying a Passenger is Dangerous – The Polaris 500 CC EFI X2 ATVs are designed to carry a passenger, but the other ATVs rented through Arco Oasis Rental LLC are single passenger ATVs. Regardless of whether the ATV was designed for a passenger or not, carrying a passenger greatly increases the challenge of driving an ATV. A passenger could interfere with your ability to move around to maintain your balance and control of the ATV.
Be Alert for Off-Road Hazards – The terrain can present a variety of challenges when you ride off-road. Continually read the terrain for unexpected turns, drop-offs, rocks, ruts and other hazards. Always keep your speed low enough to allow time to see and react to hazards.
Ride within Your Ability – Pushing the limits is another major cause of ATV accidents. Never ride beyond your personal abilities or faster than conditions warrant. If you are not sure if you can, don’t do it. The speed limit for all maintained city and county roads for ATV use is 15 MPH.
DON’T DRINK & DRIVE – Alcohol/drugs don’t mix with riding an ATV. Even one drink can reduce your ability to respond to changing conditions, and your reaction time gets worse with each additional drink. Furthermore, being caught intoxicated on an ATV on any county or city road will result in the harsh penalty of a DUI conviction.
Sharp turns at too high of a speed can cause serious accidents and injury. Please use slow speeds when turning sharply.
Control Speed – Riding at excessive speed increases the chance of accidents.
NOTICE! Accidents are EXPENSIVE, not only for your body, but the body of the ATV. SLOW DOWN to help avoid accidents. The typical roll-over costs $1,200!! That comes out of your pocket. PLEASE BE CAREFUL!!!
IMPORTANT FOR ATV USERS! There is a concerted movement to ban ATVs from the national forest. This anger against them is caused by irresponsible use of ATVs. Please do y our part to ride ONLY on designated trails. YOU MUST NOT GO OFF ESTABLISHED TRAILS. VIOLATIONS IS PUNISHABLE BY UP TO $750 FINE FOR THE FIRST OFFENSE! We have great places to ride without going where you don’t belong. A new track across a meadow or stream destroys vegetation and causes erosion.
PLEASE be careful with the ATV. There have been several near fatal and fatal ATV accidents in Idaho in recent years. Not only is the renter liable for injuries, the renter is also liable for all damage to rented ATVs.
Where to ride: Arco, Idaho is an ATV friendly community. The city roads in Arco are identified with an ATV rider sign if access is allowed. The park in downtown Arco has a kiosk that shows all the city roads that can be accessed. The city roads lead to county roads that allow access to a vast amount of public land. The best and easiest location to go is the Big Southern Butte, clearly visible to the East of Arco Oasis Rental LLC. This is a National Natural Landmark, and is accessible to the top via a non-maintained 4X4 road. Other locations include the Mackay Mines, and anywhere the roads take you within the millions of acres of BLM land to the East of Arco. Be careful not to trespass on the Idaho National Laboratory (INL), a government facility that has 860 square miles and is about 30 miles northeast of Arco Oasis Rental LLC. All roads crossing the INL boundary are clearly marked with Do Not Enter signs. Other places of interest that permit ATVs include Copper Basin to the southwest that includes old mining camps, and the roads on the eastern side of Craters of the Moon National Monument. All Machines: The right hand brake (front brakes) has the best stopping power because it has a brake on both front tires. The left hand brake and the right foot brake are the same b rake, on rear tire. The front brakes stop you much faster than the rear brakes. The Gas Lever is on the left side by your knee. Run the ATV with the lever in the ON position (pointed down). It will run out of fuel at about 3 gallons of usage. At that point, the gas lever can be switched to the reserve position (pointed up), which will allow about another gallon of fuel before completely running out. The range is about 75 miles on a full tank of fuel. Upon returning, make sure to fill the tank with fuel. ATVs are all automatic transmissions, meaning that the throttle lever on the right handlebar needs to be actuated with your thumb to provide acceleration. Start by turning on the key, using the key like a car to start it while pushing the throttle lever on the right handlebar with your thumb. When cold, you may have to use the choke lever. To stop, turn off the key. The kill switch on the left handlebar can be used to turn off the machine, but make sure that the key is turned off or the battery will run dead. While trying to start, if it won’t start, check the kill switch and make sure it is in the on position. If the battery is dead there is a manual pull cord on each machine. Registration and proof of insurance is under the seat. All ATVs have an Idaho ORV sticker on the left side. There is a can of Fix-A-Flat and a tow rope under the seat.
A more thorough inspection and training procedure will be followed at the time of check-out, including a driving test to make sure operation is fully understood. RIDER LIABILITY FOR DAMAGE AND INJURY NOTICE We can’t emphasize enough how careful you must be when riding these ATVs. The Arco Oasis Rental LLC team has personally ridden them many miles without damage or any kind of accident, but many people throughout Idaho have been involved in ATV related accidents. Most wrecks are caused by “hot-rodding”, going too fast, or carelessness (steep hillsides). Some injuries have been very serious such as death. Riders bear the full cost of repairs and medical expenses.
